2. Description of Service

Captu® provides an online marketplace that connects event participants with professional photographers, enabling users to find, preview, and purchase high-quality photos from sporting events using bib number recognition technology.

3. User Accounts

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these terms.

4. Purchases and Payments

  • All prices are displayed in the applicable currency and include applicable taxes unless stated.
  • Payment is required at the time of purchase.
  • We use secure third-party payment processors to handle transactions.
  • Digital photo downloads are delivered immediately upon successful payment and are non-refundable except as required by law.

5. Intellectual Property

All content on the Captu® platform, including but not limited to text, graphics, logos, and software, is the property of Captu® or its content suppliers and is protected by intellectual property laws.

  • Photo Rights: Photographers retain copyright of their images. When you purchase a photo, you receive a personal, non-commercial license to use, download, and print the photo.
  • Trademark: Captu® is a registered trademark. Unauthorized use of our trademarks is prohibited.

6. Permitted Use

You agree to use the Service only for lawful purposes. You may not:

  • Use the Service to violate any applicable laws or regulations
  • Attempt to gain unauthorized access to our systems
  • Use automated systems to access the Service without permission
  • Reproduce, distribute, or sell photos without proper authorization
  • Remove watermarks or other protective measures from preview images

7. Photo Content and Likeness

By participating in events covered by Captu® photographers, you acknowledge that your image may be captured and made available for purchase on our platform. If you wish to have your photos removed, please contact us with proof of identity.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPTU® SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

10. Indemnification

You agree to indemnify and hold harmless Captu®, its affiliates, and their respective officers, directors, and employees from any claims arising from your use of the Service or violation of these terms.

11. Modifications to Terms

We reserve the right to modify these Terms of Use at any time. We will notify users of significant changes by posting a notice on our platform. Continued use of the Service after changes constitutes acceptance of the modified terms.

12. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of Argentina, without regard to its conflict of law provisions.
